About Adult Mental Health Treatment Court

Description
The mission of Mental Health Case Management Programs is not to create new services but to merge and blend existing services in a more efficient, pragmatic and continuous way across the judicial system. By strengthening existing, forging new partnerships and eliminating gaps in services, this court program creates that efficiency. A Senior Court Program Specialist position is provided to the court for case management, through grant revenue by the Florida Department of Children & Families through Gracepoint the Source for Wellness.

Mental Health PTI
Despite the lack of resources to develop a Mental Health Treatment Court in this circuit, the court has developed a protocol between the Public Defender’s Office and the State Attorney’s Office for defendants who may be eligible for Mental Health Pre-trial Intervention (MHPTI), who refer cases from the felony divisions to the Senior Court Program Specialist, Court Mental Health Liaison (on-site position funded by the Department of Children & Families through Gracepoint the Source for Wellness.). If the defendant does, in fact, have a major disorder, Axis 1, meets the statutory requirements for PTI, is amenable to treatment and substance abuse is not the primary treatment, case management is now an option. The Court Mental Health Court Liaison works to find a community mental health provider to monitor the defendant’s treatment needs. Based on the assessment, the treatment plan is included in the contract between the State Attorney and the defense.

History
The first case for MH PTI was referred in the summer of 2008. Today, referrals come from all regular felony divisions of the Criminal Justice & Trial division.

What is Mental Health Pretrial Intervention (MHPTI)?

MHPTI is a variation of Pretrial Intervention (PTI). MHPTI includes mental health treatment and monitoring as part of PTI agreement conditions, typically in lieu of community service. Please see Florida Statute §948.08 for more information about PTI.

Who is eligible for Mental Health Pretrial Intervention (MHPTI)?

Persons approved by the State Attorney who meet the criteria for Pretrial Intervention (PTI) F.S. §948.08 and have a major mental health disorder are eligible for MHPTI. MHPTI, however, is not intended to be used in lieu of Drug PTI for defendants charged with drug offenses. Please see the MHPTI procedures and contact your attorney to determine whether you are eligible.

What types of charges are eligible for Mental Health Pretrial Intervention (MHPTI)?

Per Florida Statute §948.08 the criminal offense for which the defendant has been arrested or charged must be a non- violent third degree felony. However, consult your attorney to determine whether you may be eligible for MHPTI.

Who makes the determination whether I can participate in Mental Health Pretrial Intervention (MHPTI)?

Participate in MHPTI is based on the State Attorney’s discretion and eligibility criteria.

What are the requirements of the Mental Health Pretrial Intervention agreement?

Requirements vary as the State Attorney may modify conditions. All MHPTI participants, however, must participate in mental health treatment and monitoring. Please see sample agreement for more information.
