Schedule

ALL EXHIBITS FOR ANY EVIDENTARY HEARINGS OR TRIALS SET WITH JUDGE TIBBALS DURING THE PANDEMIC NEED TO BE SUBMMITTED TO THE COURTHOUSE  NO LESS THAN 5 BUSINESS DAYS PRIOR TO THE HEARING. PREFERRED 7 DAYS.

Counsel are advised that failure to promptly schedule matters may be a violation of the Rules of Professional Conduct .  See, Rule 4-3.2 Expediting Litigation and the Comment.

"Dilatory practices bring the administration of justice into disrepute. Although there will be occasions when a lawyer may properly seek a postponement for personal reasons, it is not proper for a lawyer to routinely fail to expedite litigation solely for the convenience of the advocates . Nor will a failure to expedite be reasonable if done for the purpose of frustrating an opposing party’s attempt to obtain rightful redress or repose . It is not a justification that similar conduct is often tolerated by the bench and bar. The question is whether a competent lawyer acting in good faith would regard the course of action as having some substantial purpose other than delay. Realizing financial or other benefit from otherwise improper delay in litigation is not a legitimate interest of the client .”

UMC/Open Docket Dates
must have been referred to the GM first. If the referral is objected to then the matter may be scheduled with Judge Tibbals. If this procedure is not followed, your motion will not be heard. ALL Post-Judgment Child Support matters MUST go before the General Magistrate or Hearing Officer (no referral required and objections may not be filed). (See Administrative Order S-2013-075) Schedule through JAWS.

 

No defaults on the CMC- . Schedule through JAWS on the 15 Minute Motion Calendar. AND MUST BE SET BY ORDER FOR FINAL HEARING

The parties, re required to prepare the order setting trial. For Family Law case's that order is going on Judge Tibbals website under forms.

 

The parties will be required to submit a Pretrial Conference Order through the EPortal, If the parties cannot agree to a form of the order, you may each submit your "proposed" order to the Judicial Assistant in a Word Format for Judge Tibbals to make the final decision.
