Agreement of Defense Counsel

By signing below defense counsel understands and agrees to the following:

  1. Defense counsel is responsible for noting new court date, informing his/her client, and ensuring the client's presence if the new court date is the type of proceeding where the client's presence is required [e.g., trial, change of plea or motion].
  2. No more than THREE disposition dates are allowed [not including the dispo date set from the written plea of not guilty] unless approved by the Court. An attempt to request a fourth or subsequent disposition date through this written method without Court approval will result in the case being set for trial and withdrawal of counsel's privilege of requesting new court dates through this written method.
  3. Speedy trial is waived.
  4. By using this form, you hereby stipulate that all motions, including Motions in Limine, Motions to Dismiss, and Motion to Continue are abandoned if not Filed and Heard prior to the Pre-Trial Conference and hereby acknowledge and understand that all parties, including the Defendant, must be present at Pre-Trial Conference. No waivers of appearance will be accepted at Pre-Trial.

**NOTE: Per Judge Perrone if the Attorney is not present at the court date and has not filled out a form, a capias will be issued. In that case you will need to file a Motion to Recall the Capias and have it heard before the court.
