Notice: Reopening of the Complex Business Litigation Division      The Complex Business Litigation Division (CBLD), Division L, will be reopening to newly filed cases on May 15, 2009. Effective on that same day the division will also accept transfers of complex business cases pending in other civil divisions.
      When Division L reopens, CBLD procedure revisions will go into effect and some existing procedures are being revised. These changes are detailed below under CBLD Procedures

Complex Business Litigation Division Established for certain business litigation. The business case must fall into one of two categories:

  1. The litigation must be between business persons or entities and the amount in controversy must be greater than $150,000; or
  2. without regard to the amount in controversy, the business litigation must relate to internal affairs or governance of the business, trade secrets, non-compete agreements, intellectual property or several other areas set forth in Administrative Order S-2008-105.

At the initial case management conference, a litigation track will be assigned which is designed to set a trial date within the stated number of months from the filing of the complaint:

• Track 1 – Business Expedited (within 13 months);
• Track 2 – Business Standard (within 18 months); or
• Track 3 – Business Complex (within 24 months).
